* NOTICE: By accepting and using this password, you agree that your use of the Wynn Wellness BrandHub, and the Images, as defined below, are governed by these Conditions of Use (or the "Agreement"). You further agree that: (1) you have read and understand the Conditions of Use; (2) by entering the Site you will be bound by, and comply with, these Conditions of Use; (3) your use of the Site and Images is expressly conditioned upon your compliance with the Conditions of Use; and (4) Wynn Wellness reserves the right to restrict or terminate your access to the Site at any time in its sole discretion. If approved you will be issued a password and ID to BrandHub within the next 30 days.

CONDITIONS FOR USE OF LOGOS, ARTWORK, AND PHOTOGRAPHY

This web site (the "Site") is owned and operated by Adgistics which, by and through its affiliates, subsidiaries, and licensees, owns or has the right to use ad license all material on this Site. In utilizing the logos, artwork, designs, photography and images (the "Images") on this Site, you are permitted to use and publish the Images subject to the following restrictions:

  • 1. Usage Rights: Except as otherwised authorized in writing by Adgistics, you are not permitted to:
    • 1.1 Redistribute the Images as stock photography or web art;
    • 1.2 Use any of the Images on any product, service or communication other than that produced by or for Wynn Wellness BrandHub, or to express or imply endorsement or sponsorship of any commercial product, service or activity;
    • 1.3 Use the Images for any unlawful purpose;
    • 1.4 Modify the Images;
    • 1.5 Use the Images, or any modification thereof, to create obscene or scandalous works, as defined by US Federal law at the time that the work is published;
    • 1.6 Use the Images in any way that infringes upon or violates this Agreement or a trademark, trade name or other intellectual property right owned by any other person or company; or,
    • 1.7 Use the Images in electronic format, including on-line use and multi-media applications UNLESS the following conditions are met, in addtion to the other restrictions contained in this Agreement:
      • 1.7.1 The Images are in a format which prevents copying;
      • 1.7.2 The Images comprise only a small portion of the content of the application; and,
      • 1.7.3 Any ability to download and save the Images is disabled or otherwise not allowed.
  • 2. Trademark rights and ownership:
    • 2.1 Your use of the Images on this Site is subject to this Agreement and any other agreement between you (or your company) and Adgistics.
    • 2.2 The Images, and any other intellectual property on this Site is and shall remain the exclusive property of Adgistics. You acknowledge that you will not assert any right, title or interest of any kind or nature whatsoever in or to the intellectual property rights contained in the Images nor will you challenge or contest any of Adgistics’s rights therein.
    • 2.3 In addition to any other rights Adgistics may have, your right to use the Images on this Site is terminable upon notice from Adgistics.
    • 2.4 All rights not expressly granted herein are reserved.
  • 3. Cooperation: You agree to execute and deliver to Adgistics any additional documents, statements, and instruments and take such other action as may be reasonably necessary in Adgistics’s discretion, to carry out more effectively the purposes of this Agreement, including Adgistics’s enforcement of its rights in the Images.

  • 1. Copyright Infringement Policy:In accordance with the Digital Millennium Copyright Act (“DMCA”) and other applicable laws, Adgistics has adopted a policy of terminating, in appropriate circumstances and at Adgistics’s sole discretion, the Site access of those who infringe the intellectual property rights of Adgistics or any third party.

No Warranty:Adgistics does not warrant that the functions contained in the Site will be uninterrupted or error-free, that defects will be corrected, that this Site or any server that makes it available is free from viruses or other harmful components or that successful results or outcomes will result from your use of information on this Site.
  • 4. Site Access:You are responsible for configuring your information technology, computer programs and platform in order to access this Site. You are responsible for your own software to protect against viruses and the like.
